On August 17, 2017 Councilman Michael D’Aquila stated on the record that he was in receipt of 60 design development drawings as well as a design development estimate from a third party estimator.

I decided to OPRA these documents to take a look at exactly what is being planned for the $31,000,000 municipal building project in order to assure that the Berkeley Heights Town Council is optimizing benefit for the residents. My request was denied by the township clerk stating the reason: “Pursuant to N.J.S.A. 47:1A-1.1 they are Inter-agency or intra-agency advisory, consultative or deliberative materials” Which means they have it but are claiming they do not need to provide it. . So the Berkeley Heights Municipal Clerk, most likely under orders of the Mayor, Council and/or Town Attorney blocked the request to see those public documents.
At the November 21, 2017 Town Council Meeting I asked Michael D’Aquila about when we would see these detailed documents. He seemed confused as to what I was talking about as if he forgot what he had said on August 15, 2017. He seemed to state that there are no detailed plans only the 6 drawings that we have already been presented.
What happened to the 60 design documents that Michael D’Aquila stated on the record that he received. Why Deceive? Where did the documents go?
